1. Acceptance of Terms

By downloading, installing, or using the PaNyumba mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.

PaNyumba is operated by Czest Tech ("we," "us," or "our"). These Terms govern your access to and use of our services, including the App and any related features.

2. Description of Service

PaNyumba is a property rental platform that connects landlords with potential tenants in Zambia. Our services include:

  • Property listing and search functionality
  • In-app messaging between users
  • Map-based property discovery
  • Property listing management tools for landlords
  • Optional premium features and boosts

3. User Accounts

To use certain features of the App, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your account credentials
  • Promptly update your information if it changes
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

You must be at least 18 years old to create an account and use the App.

4. User Conduct

You agree not to:

  • Post false, misleading, or fraudulent property listings
  • Impersonate any person or entity
  • Harass, abuse, or harm other users
  • Use the App for any illegal purpose
  • Attempt to gain unauthorized access to the App or its systems
  • Upload viruses or malicious code
  • Scrape or collect user data without permission
  • Interfere with or disrupt the App's functionality

5. Property Listings

Landlords who post property listings agree that:

  • All information provided is accurate and truthful
  • They have the legal right to list the property
  • Photos and descriptions accurately represent the property
  • Pricing information is correct and up-to-date
  • They will respond to inquiries in a timely manner

We reserve the right to remove any listing that violates these Terms or that we determine to be inappropriate.

6. In-App Purchases

PaNyumba offers optional in-app purchases, including:

  • Coin packs for boosting listings
  • Premium subscription features
  • Featured listing placements

All purchases are processed through Apple App Store or Google Play Store. Refunds are subject to the respective store's refund policies. Coins and premium features are non-transferable and have no cash value.

7. Intellectual Property

The App and its original content, features, and functionality are owned by Czest Tech and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of content you post to the App but grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with our services.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind. We do not guarantee:

  • The accuracy of property listings
  • The identity or reliability of other users
  • That the App will be uninterrupted or error-free
  • Any specific results from using the App

PaNyumba is a platform that facilitates connections between landlords and tenants. We are not a party to any rental agreements and do not verify properties or users. Users should exercise due diligence before entering into any rental arrangements.

9. Limitation of Liability

To the maximum extent permitted by law, Czest Tech shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from your use or inability to use the App, any transactions between users, or any other matter relating to the App.

10. Indemnification

You agree to indemnify and hold harmless Czest Tech, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

11. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice, for any reason, including:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Behavior harmful to other users or the platform

Upon termination, your right to use the App will cease immediately. Provisions that by their nature should survive termination will remain in effect.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes through the App or by email. Your continued use of the App after changes are posted constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Zambia, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of Zambia.
